1. About ChiwawaPay

ChiwawaPay is a digital payments platform that enables individuals and businesses to send, receive, and manage payments online.

ChiwawaPay is operated by T-INFLUENCER Ltd, registered in Tanzania.

2. Eligibility

To use ChiwawaPay, you must:

  • Be at least 18 years old or legally capable of entering into a binding agreement.

  • Provide accurate, complete, and verifiable information during registration.

  • Operate a legitimate business or personal activity in compliance with applicable laws.

We reserve the right to verify your identity, business documents, and banking information before or during use of our Services.

3. Account Registration and Security

  • You are responsible for maintaining the confidentiality of your account credentials.

  • You must promptly notify ChiwawaPay if you suspect unauthorized access or account misuse.

  • You agree not to use another user’s account or share your credentials with third parties.

ChiwawaPay is not liable for any loss resulting from unauthorized use of your account.

4. Acceptable Use

You agree to use ChiwawaPay only for lawful purposes. You must not use our Services to:

  • Engage in fraud, money laundering, terrorism financing, or illegal trade.

  • Process payments related to prohibited goods or services (e.g., narcotics, weapons, pornography, gambling, or counterfeit products).

  • Circumvent transaction limits, network rules, or regulatory compliance checks.

Violation of these terms may result in immediate suspension or termination of your account.

5. Transactions and Settlements

  • ChiwawaPay processes transactions on behalf of users using supported payment methods (mobile money, card, or bank transfer).

  • Transaction success depends on the status reported by the payment processor or financial institution.

  • Settlement timelines vary depending on bank processing, mobile network availability, and compliance reviews.

  • ChiwawaPay may hold or delay funds for security or compliance reasons.

We do not guarantee instant settlement or reversal once a payment is completed.

6. Fees and Charges

You agree to pay applicable transaction and service fees as published on our website or dashboard.
Fees may vary based on payment method, country, and transaction volume.
ChiwawaPay reserves the right to update its pricing from time to time with notice to users.

7. Refunds and Disputes

  • Refunds may be processed only in accordance with our Refund Policy and network partner terms.

  • In the event of a chargeback or dispute, ChiwawaPay may withhold equivalent funds from your balance pending resolution.

  • You agree to cooperate with investigations and provide any documentation required to resolve disputes.

8. Data Protection and Privacy

ChiwawaPay collects and processes your personal data in accordance with our Privacy Policy and applicable data protection laws.
We use your information to verify identity, process payments, prevent fraud, and improve our Services.
By using ChiwawaPay, you consent to this processing and cross-border data transfers as necessary.

All trademarks, software, design, and logos related to ChiwawaPay are owned or licensed by Chiwawa Group.
You may not reproduce, modify, or distribute our content or software without written permission.

10. Limitation of Liability

To the fullest extent permitted by law:

  • ChiwawaPay shall not be liable for indirect, incidental, or consequential damages arising from the use or inability to use the Services.

  • We are not responsible for network outages, system downtime, or delays caused by third-party payment processors.

  • Our total liability in any claim shall not exceed the total fees you paid to ChiwawaPay in the three (3) months preceding the event.

11. Suspension and Termination

We may suspend or terminate your account if:

  • You violate these Terms or applicable laws.

  • Your activity poses a risk to other users or the platform.

  • Required documentation or verification fails.

You may close your account anytime by written request, subject to settlement of outstanding balances or disputes.

12. Compliance and Reporting

ChiwawaPay complies with the Bank of Tanzania and other relevant financial regulations.
We may share user information with regulators or law enforcement as required by law.
You are responsible for maintaining compliance with tax and financial reporting obligations in your jurisdiction.

13. Changes to the Terms

We may update these Terms occasionally to reflect improvements, legal requirements, or operational changes.
Continued use of our Services after updates means you accept the revised Terms.

14. Governing Law and Jurisdiction

These Terms are governed by the laws of the United Republic of Tanzania.
Any dispute shall be resolved under Tanzanian law and courts.
